"This is my first MAJOR gripe about doc review in about 3 years. In July about 60 people were recruited by Lexolution to do a review for Dechert. The review initially went well. We did our job, had no complaints from the people upstairs and then all of a sudden we were told to pack our stuff because the project will be suspended until at least next week. We were given 1 hour notice on the eve of thanksgiving week! Some people actually need to prepare to take their belongings (e.g. tupperware, mugs, dinner, ipods, wires, etc.) since we practically lived there anyway and were all under the impression that the project was going to last through December
Its clearly obvious where we rank on the totem pole but they should've had the decency to give us more notice than 1 hour. To add insult to injury, we may also not qualify to file for unemployment until we find out whether in fact we are officially unemployed. We were told that we should know by Wednesday whether we're coming back. What a load of crap this is!
Of course, I'm not surprised that we were let go right before thanksgiving. After all, its not as if Dechert has any respect for social standards and to them we are a dime a dozen anyway. But at least have the decency to give us more notice than 1 hour! It is noteworthy that we were all let go on a Friday. Ya think this was planned in advance?
It just goes to show that there is no fraternity among the legal profession, nor are there any social boundaries. For the first time in my life, I'm thankful we have a penal code. Who knows, if murder were legal they would probably set the whole case room on fire just to avoid letting us have our unemployment benefits, which by the way, is not nearly enough to get by."

Just the other day I had to cancel on a recruiter bitch [she had already let me down like this a 100times] - I was sick. You should have heard how nasty she got. They can dish it out but they can't take it.
What a great "profession" law is, huh? Imagine a doctor or dentist being given one hour notice. Try to picture legions of unemployed and under-employed MDs and DDSs.

No fraternity in the legal profession? Sorry, but any practicing attorney can tell you that that's just not true. It's that your superiors don't consider legal temps to be part of the profession. That's why they refer to you as "temp JD reviewers" instead of "contract attorneys".
Even if they keep you on hold and don't work for a week pending a decision on whether to continue the project, you can claim unemployment.

Yes, there were times when temp agencies would announce a cut around mid-day and let you work until the end of the day. But those days are over. You're lucky you didn't just get a phone call over the weekend to say you don't have to come back. Or an announcement to stop working that very minute and clock out in the next 5 minutes. Those kinds of things happened all the time. Not saying it's the right thing, but the it was and is the norm.
As for the law being the only profession where such a thing can happen, you've got to be kidding. In the real world, not only do temps get cut unceremoniously and abruptly, permanent staff suffer the same types of dismissals as well. Once again, not saying it's fair. but it's normal.
I was on this project. It was not 1 hour notice. That would have been considerate. It was less than 10 minute notice. I do not blame Lex. It was Dechert who treated us like shit. I have worked for Lex before. They always treated me fairly. Unfortunately, Lex like all these other agencies has to kiss these firms asses to get the business.

I am sympathetic to many of the gripes on this board, but this is not one of them.
Here's how something like this can happen.
1. Big Case is underway and you staff with temp lawyers as demanded by the client (indeed, often clients specify temp lawyers to staff doc requests when big firms bid for the work). Budget is limited.
2. Client receives overtures for settlement and/or mediation and decides to explore it. Client tells firm "stop the press."
3. Law firm calls off the dogs and stops the work; if they keep it going, they're not going to collect anything for it and the firm has to pay - means they're just throwing money away, and the partners on the case have fiduciary responsibilities they must fulfill to the other partners and the firm.
So I'd get over it. Having said that, firms do a terrible job of treating temps respectfully. I find that if I use a little communication, and show gratitude, morale and work flow improve. Sadly, many of my peers do not get this and enjoy being petty tyrants.

I don't know that I qualify for unemployment so I've never collected. Instead I work for piddly sums of money picking up work from other attorneys. It sucks.
I hear such bad things about doc review but when it was $35/hr it seemed like you could still live off of it. Now though I never see rates that high and I still can't get a doc review gig. I interview with these agencies and then they never contact me again, I work with other attorneys sometimes that tell me the same thing has happened to them.
The profession of law sucks and it is indeed a caste system, or it's a high risk system for starting your own practice...which is really rough because of the high cost of attendance. If I wasn't living at my parents house right now I bet I'd either be in a project or on the street.
My life is a smoldering wreck and I'm not even 30 yet. Oh yeah my student loans are due again, I wonder if I get another deferment or if it's just going into default now.

Actually, in my case I'm NYU Law in the 70s, and attended a prestigious college.
Definitely not BigLaw, but I'm doing fine. I have 30 years of experience in a highly specialized part of the law. I won't starve; I make my own schedule; and I get to make my living doing interesting work.
I'm concerned, though, about the profession. In the 70s, people from Brooklyn LS and NYLS actually got jobs--not great ones, but ones where they were paid acceptably well and learned how to be a lawyer. And some of them have made out well.
That seems out of reach now for a lot of recent law grads. And conditions in these doc review jobs seem terrible. We appear to lavish a great deal of money on a small slice of people who can't possibly be worth even remotely that much right out of school--sorry BigLaw associates, I think you're in love with yourselves-- and then let the remainder suck wind.
I don't know how we got to this point. As Dave Barry says, when TSHTF, I plan to be dead.
Outsourcing to India is real, increasing, and won't go away.
It's not the jobs you SEE disappear, it's the jobs you never see in the first place that account for most of the outsourcing.
One recent economic study showed that up 25% of ALL existing American jobs could disappear to outsourcing.
In a bad economy, the outsourcing trend only intensifies as companies look to continue squeezing out profit in a weak, marginal environment.
And don't think there will be a massive influx of these jobs BACK to the USA after the current jobless recession is over.
Once these companies are able to capture the ROI from outsourcing and realize these profits, do you think they'll turn back?
You may see a small trickle of jobs move back to the US, in very spotty cases, but the vast majority of clients will maintain strengthen their outsourcing networks and lock those profit margins in as a buffer against future hard times.
That "25% figure" isn't just for legal jobs... it's for ALL American service jobs that don't require employees to be present in person with a client.
It means a wide range of legal jobs, but also a HUGE swath of all types of white collar "service" jobs including accounting, customer service, corporate research, stock market analysis, business plan writing, etc.
This is a cold law of economics -- the Law of Comparative Advantage. India, China, etc. have a comparative advantage of VERY LOW LABOR COSTS.
This will continue to pound the American economy for years to come, sapping opportunities away from college and professional school graduates.
These are the vast forces of globalization sweeping over our planet. They are immutable economic laws.
We can legislate against outsourcing, but what politician wants to speak up, since they are all beholden to their corporate campaign contributors?
The only answer will be when the economic pressures of globalization on American citizens become so great, and living standards have declined so much, that the American people are pushed into some kind of uprising.
I agree with 1:56. This profession used to be a good one for all-even those who went to law schools with less than stellar reputations. Everyone made a decent living and treated each other with respect as members of an elite profession. I miss the old days.
I agree that such short notice is unprofessional and disrespectful. But they (large corporate law firms) didn't treat their associates any better. After years at the firm, we were given four days to get out. Someone needs to start taking ownership of the profession. Clearly it won't be the ABA. If we don't enforce certain professional courtesies, then who will?

One economist described this as "the winner take all economy" a number of years ago. It comes from globalization and job outsourcing, and allows those at the top to make more and more money while squeezing out more efficiencies from below and moving labor units and profit centers around the global chessboard to where they can yield the highest returns.

It's an inexorable force, and like I said, the only way out is to take advantage of whatever remains of the burning, charred husk of our "democracy" and legislate to roll back our Corporate Masters before they find some way of rigging all elections. First job I was laid off from we made packaging Tupperware. We got axed on the FRIDAY before going on Christmas holiday. It was a surprise. We had back orders to fill. We were busy.
The machinery was shipped overseas. The plant closed. They didn't fight the unemployment. They didn't give a sh*t about us. Ironically in my last check was a bonus. The higher up promised us a bonus if we made a profit. This event changed my entire outlook to employment and business.
Christmas is the worst time for layoffs. Don't buy presents. Thank God you have job in this economy.

It was still true through the 90s. I, too, can say that I have years of experience in a specialized part of the law, I make my own schedule, and I spend my days doing interesting (and meaningful) work. I chose BLS over Fordham because BLS offered me a scholarship based on my LSAT score and Fordham didn't. Less prestige, but who cares after you've landed the first job? The lower debt load was worth it.
I agree that it seems to be much harder now, but in my day, people also had some sense of starting in a relatively low-paying job and working their way up. Now it's all "I want to start at the top and these $45K shitlaw jobs are beneath me!" And yet they put in two or three years as temps. Go figure.
This is an embarassing question - but after being unemployed for a while I am desperate. I saw a news piece on food pantries - does anyone know how they work? Are they just soup kitchens or can one buy subsidized groceries here as well? Betwen student loans and credit card payments I have nothing left to eat with!!
no 3:28, its not that the "shitlaw" jobs are "beneath" people, its that they can not in most cases afford to take them because the pay is too low to deal with the amount of debt from law school. When you went to law school 3:28, debt was MUCH lower AND it was dischargeable, that is no longer the case. The United States of America doesn't really exist anymore as a sovereign nation. I agree with this blog that the worst thing about doc review is the lack of any notice of duration and end.
This is just a question of common decency which Lexolution is sorely lacking.
I worked on a project that was on and off and every time I worked on I was just told 1 minute before "OK we don't need you any more."
Being a professional is about respecting yourself. But the sheep in doc review just sit there and put up with anything. Some do vote with their feet and leave if they have something better.
I got lectured before my last review on how much better India was. I felt so demeaned having to listen to this. But the point of the speech was to warn us how unneeded we were.
Why doesn't Mr. Krowitz move to India then? I am sure his doctor wife would appreciate a break from supporting his sorry ass.

Well, here's one thing we did back in the 20th century: we did some research on the legal job market BEFORE we took out loans. Apparently all you 21st century genuises take out huge loans and trot off to third-tier schools secure in the fantasy that you'll get jobs starting at $160K and will pay off that debt before you turn 30. The fact that it doesn't work out that way isn't anyone's fault but yours. People who did that back in the 90s only expected to start at $90K, but they were just as deluded.
It's not about the changes in the bankruptcy law or the size of the debt. It's about a lack of realism about your chances and a failure to plan accordingly. And that kind of stupid isn't limited to any particular time or place or generation.

PEOPLE, DO NOT ACCEPT PROJECTS PAYING LESS THAN $35 PER HOUR. If you think about it, when a big pharma, financial, or other corp is fighting a case and needs work to get done (ie. 80 attorneys to review docs for 2-4 weeks), they NEED this work to get done. They hire an agency to staff this project. SOMEONE (agency?) is pocketing a sum, due to availability of unemployed attorneys, and paying $25 per hour or even lower (AND STRAIGHT TIME, NO OT). What do you suppose will happen, if every (or most) attorneys REFUSE to work for $25 per hour? I don't think shipping the work to india will be a problem - if it was easy to do and without issues, EVERY firm/corp/agency would be doing this. In the end, because this work needs to get done within a set time, they will have to hire 80 attorneys, and will pay up.

I think the likelihood is very high that it will happen, about 90% or more. Sen. Reid wants to get reelected, with 13.5% unemployment in NV, and all policy that moves on Capitol Hill will be driven by this. Many Republicans will be forced to vote for it (even if their leadership opposes it), and Obama will sign it.

I don't see how such great attorneys could have only gotten into some of the worst law schools. I mean the average attorney that's working in any field is doing trial work or handling complex matters after 5 years. The staff attorneys are only in charge of the latest doc. review software. Must be something specific to S&C where they keep some of the best and brightest locked in the basement working 70 hour work weeks and giving them no experience.
You would think that would burn someone out after 4 or 5 years.

In any event, I'll be stopping off in Manhattan for a few days next week to get in a little doc review. When I spoke with Recruiter, she said my degrees from Choate Academy, Yale and Havard Law were too "elite" I think was the term she used, but heck... I like to do a little work "on the ground" with the peonage once in a while, to see how the other 99,999,999/100,000,000 live. My Daddy says it's a good idea... Keeps one sharp, and never lets one forget the specialness of his station in life. Sort of a "Noblesse Oblige" thing, as I view it.

I'd like to know a couple of things about the situation in 9:45's article.
1) Did the judges who denied Bowman's application accept any campaign contributions from any of the creditors, banks, credit card companies, or lenders which hold his debt?
2) Did Bowman ever think for a second that not paying so much debt could put his NY application at risk? My brother-in-law applied to the Texas bar and was rejected because of MUCH smaller outstanding debts than Bowman, on the basis of "financial responsibility". (He is now practicing law in another state).
3) Can't the NY Bar work out some kind of good faith debt repayment plan with people like this, to allow them to pay down their debt by letting them do essentially pro-bono work, where the state would garnish part of the wages and pay the lenders?
Another question is where do you draw the line on outstanding personal debt disqualifying someone from being accepted to the Bar? $50,000? $100,000? $300,000? $314,282.67?
Unless the NY judges who decided this case are willing to explicitly state what amount of debt is unreasonable, and exactly what payment history is reasonable or unreasonable, their decision fails for being too vague.
Ex-felons can be made lawyers - and not people who have debt???

Well to be honest, high school is a bit of a blur. Truth be told, I was a bit of a rabble-rouser and got bounced back and forth between Choate, Phillips Andover Academy, and a couple of other prep schools -- and even one military school -- which will remain nameless, and some of which, I can honestly say, I don't even recall. It seemed that trouble followed me around recklessly from this place to that. You know, the missing coed here, found at the bottom of a river. (Thankfully the parents decided not to press charges against me or any of my friends...) The accusations of "rape" there, all proved to be accidents or self-inflicted.
So maybe when I say "Choate Academy", it's just proof that I am a lost soul whom you should pity. Yes, it's a hard life, scampering about every few months from the penthouse in the 16th Arrondissement, to the villa on the family compound in Polynesia, to one of the mansions outside Buenos Aires, to one of the renovated apartments in Kensington (too many rooms to be of any use!) or helicoptering it from the Merriweather II to the Palm Beach place.

NEW DELHI: Facing the heat of recessionary pressure, India's legal process outsourcing (LPO) industry is likely to see a decline in revenue and
is expected to reach $440 million dollars (around Rs 2,000 crore) by 2010 end, a report said.
According to a report by business intelligence & research firm ValueNotes, global economic downturn has slowed down LPO industry and is changing the service provider's landscape.
"Revenues from the offshore legal services industry were USD 320 million for 2008 and are expected to reach USD 440 million by 2010 end," it said.
The offshore legal services industry grew at a rapid pace until 2007. However, the slow down in buyer market impacted the offshore industry resulting in falling growth rate.
The industry that was growing at a compound annual growth rate (CAGR) of over 40 per cent over the last four years until 2007, dropped to 28 per cent in 2007-08, and further reduced to 16 per cent for 2008-09.
The fall is primarily due to recessionary cost pressures impacting the global legal services market and the subsequent affect on the number and value of offshoring contracts, the report said.
However, industry experts are hopeful about the future of Indian LPO sector

I also know a New York licensed attorney, just a real sociopathic dude with the shallow mentality of your average street whore, went to a law school in Auckland of all places, was barred from the NASD (securities dealers) for stealing six figures from clients' accounts and never responded to the investigation, just committed unemployment insurance fraud against the state of New York, and yet...he is still licensed by the New York state bar. He was outed at a doc review in Los Angeles and is probably selling his closeted ass on the mean streets of Hollywood. Good riddance to that type of contract attorney. Fame whores can get tossed with him as well.
