Last One Out Turn Out The Light

"In a move that is sending shudders through the global BigLaw community, Rio Tinto has hired a team of Indian attorneys in an effort to cut by 20 percent its annual legal budget of about $100 million."

And it's not just contract attorney work anymore.

"Although outsourcing legal work to India is far from a novel concept, Rio Tinto is bypassing law firms and outsourcing legal work directly. Plus, not just legal processing but substantive legal work is being handled by the Indian attorneys it retained through CPA. Thus, the Rio Tinto move represents 'a fundamentally new way of working,' the Times article explains."

Rio Tinto is an Australian mining company, which mines and sells metals all over the world. I would imagine most of their big transactions are international in nature, so advisors on international law could be qualified to help, no matter what jurisdictions those attorneys are licensed in. (I assume we are talking about transactional attorneys here and not litigators.)

Generally, though, attorneys well-versed in international transactions either have degrees from respected "international" schools like Georgetown, Oxford, LSE, etc. or have built up reputable international practices.

The idea of using cheap Indian attorneys to replace international transactional lawyers is interesting, novel, and scary, but in a very chilling sense, is logical, since the jurisdiction where the attorneys are barred in isn't the most critical element in the mix, unless they are actually litigating.

I wouldn't get too worked up about it. This has been happening for a long time. They use them -- it becomes a fad for a while -- and then sometimes the quality is not high or they just prefer them closer and the shift back to NYC or DC.

I used to work in project finance and it happens all the time.

I am Indian. I was born there but educated here since I was 16. Trust me India is becoming a fad, these companiesn are going to try it out for a while, scare big law firms into cutting their rates and come back to BigLaw.

The quality of education is much higher in the US-nothing beats it.

I am the Indian guy again -- they speak English very well, and are very smart and hard-working people but the kind of training and sophitication you get in a big city like New York is unsurpassable.

And I say this even for other lawyers in the US, in Kansas, or Arizona, they are no match for BigLaw/NYC. It is a is a mean, ruthless machine, but also very sharp and sophisticated

When it comes to racial preferences, Barack Obama and Sonia Sotomayor are ideological twins, although most Americans don’t realize it yet. Unlike the master politician, however, Sotomayor tends to rub people the wrong way. Still, the Republican Senators are highly unlikely to be able to stop Sotomayor. And it’s not clear that they should want to, since once on the Court, the mediocre and abrasive Sotomayor is unlikely to evolve into a William Brennan-like master backstage manipulator of the other Justices.
Still, a lengthy hearing over Sotomayor would be the best opportunity for the GOP to begin the process of enlightening the public that Obama isn’t the post-racial President that David Axelrod has spun him as. Clearly, the New Haven firefighter reverse discrimination case of Ricci v. DeStefano should be central to the hearings.
Yet, old-fashioned chivalry and post-modern sensitivity both dictate that a bunch of white male conservative Senators like Jeff Sessions can’t be seen asking too many probing questions of a lady / minority. The GOP needs a bad guy to pound in these hearings, but Judge Sotomayor isn’t a guy.
So, the GOP Senators should subpoena a witness on the Ricci v. DeStefano case. They should subpeona and then roast alive on the witness stand the defendant, beady-eyed New Haven mayor John DeStefano (seen here), who engineered cheating Ricci and company out of their promotions. This will associate DeStefano’s petty political machinations to please his main black supporter to Sotomayor, Obama, and racial preference supporters in general.
For examples of the kind of questions they could flail DeStefano with, just refer to the Supreme Court’s oral questioning in the case. For example, Mayor DeStefano’s city attorney claimed that the city had strong evidence for discarding the test as invalid after finding out the results by race. But Justice Samuel Alito pointed out the preposterousness of that claim in a scalding rhetorical question:
“[The city] chose the company that framed the test, and then as soon as it saw the results, it decided it wasn’t going to go forward with the promotions. The company offered to validate the test. The City refused to pay for that, even though that was part of its contract with the company. And all it has is this testimony by a competitor, Mr. Hornick, who said—who hadn’t seen the test, and he said, I could do a better test—you should make the promotions based on this, but I could give you—I could draw up a better test, and by the way, here’s my business card if you want to hire me in the future.
“How’s that a strong basis in the evidence?”

BigLaw is mostly a creature of the USA, and as the USA (and the American dollar) becomes relatively less important on the global scene, in comparison to rising countries like China and India, there is no reason whatsoever that international companies should be locked into using US law firms to do their international transactions.

BigLaw, like BigBanking and BigAutos, is another American anachronism -- an example of the failure of the topheavy American corporate model in which a top tier of "winners" -- greed-motivated corporate executives -- rape their companies and exploit lower tiers of workers to fatten their wallets.

Rio Tinto is based in London and Melbourne. It is a dual-listed company, listed on both the London LSE's FTSE and the Australian Securities Exchange.

If you look at the chart on the Wikipedia page, most of their subsidiaries are in Australia, UK, Brazil, South Africa, etc. with only a couple in the US.

China has more of a claim on Rio Tinto than America, and by the way Chinese industries buy much more ore from Rio Tinto as well.

Tired of ABA mail?

I just moved, I'm sorting out paperwork, and the amount of junkmail from the ABA is insane. I just sent them this email, in case y'all want to do the same:

Dear Sir/Madame at the ABA,

I do not intend to join the ABA, and would like to be taken off your mailing and phone lists for two main reasons:

1. When you called a couple years ago and asked me to renew membership, I asked the person on the phone if there was a way to do this without all the solicitation and snail mail. She said something to the effect that she would put me on a low-mail or no-mail list. However, I soon started getting more solicitation for insurance and other products, confirming my belief that the ABA is essentially a business auctioning off it's members to other businesses.

2. I cannot afford your membership fees or any of the products for which you send solicitation due to what I believe to be a very self-serving and unethical decision of the ABA that caused me to be unemployed for 6 months and under-employed for longer. Your decision to say that document review could be outsourced to other countries and performed by non-US admitted attorneys making a fraction of the hourly wages caused a huge drop in document review projects in the US, as well as a drop in the quality of document review work performed. This was clearly a decision to benefit partners of law firms who benefit from these low wages, at the expense of US attorneys, clients, etc. I am disgusted with this decision.

Please take me off your mailing and call list immediately.

You're actually in worse shape now than before you started law school?

I wonder if you can give a law degree BACK to a law school, in return for having your school debt discharged?

I realize it doesn't make any sense legally, as the school is a third party beneficiary of the contract between the lender and the student, and not one of the parties to the loan, but I wonder if somehow this could be justified.

The other thing about having a law degree is that it actually renders people "overqualified" for a lot of non-law white collar jobs -- in a lot of professional settings, such as government contract negotiations, procurement, public policy, business management, business analytics, etc. -- having a JD can be just as much of a liability as an asset. Often a job applicant with a law degree is rejected for those kinds of jobs because working around an attorney in a non-legal setting sometimes makes people feel uncomfortable -- they think that the extra professional qualification might allow that person to "leap frog" over them for promotions, once his foot is in the door -- so why not reject him now, keep him out of the game, so that he doesn't become a threat later on?

That and just a general dislike or disregard for lawyers, or a perception that JDs expect higher salaries and might bolt at the slightest whiff of an offer of a law job -- make many white collar employers reluctant to consider people with JDs and especially with bar admission.

It's a lose-lose situation for many attorneys. Can't find a job within the profession because of the fast-shrinking market; can't find a job outside of the profession because the law degree is like the proverbial scarlet letter hanging around your neck.

Because the company that outsourced the jobs bypassed the BigLaw firms. The BigLaw firms had no say in it at all, and neither did their pawns in the ABA.

When BigLaw partners want to outsource the work of peon associate attorneys, to improve their own bottom lines, they do so with the willing connivance of their puppets in the ABA.

But when big multinational corporations want to improve THEIR bottom lines, now Rio Tinto has shown them that they can just bypass BigLaw and contract directly with India.

And as it says in the article, the BigLaw firms are forced to cooperate with the Indian attorneys, or risk hurting relations with their corporate partners even more, leading to more circumvention.

I can see Corporate America eventually outsourcing most transactional work to India. Contract drafting, contract review, structuring mergers and acquisitions, etc. will all go to Indian attorneys earning 1/6th of the pay of American attorneys.

That's what Corporate America WANTS you to believe. The flood of immigration from cheap-labor companies happened because CORPORATE AMERICA wanted the cheap labor here, pure and simple.

Just as Corporate America had its way with admitting cheap labor into the US, trampling over laws, the Constitution, regulations, and the will of American citizens, so too will Corporate America eventually bamboozle enough people to secure the mass outsourcing of the legal profession to cheap labor countries.

By the way, I'm actually laughing at all this because I, too, am an immigrant who wasn't born in this country, and what I see is a Republic that has sold out its own people and is on the fast track to its own demise.

All you foolhardy Americans that keep supporting the conservative right and "libertarianism" are in effect selling yourselves and your way of life down the river, while patting yourselves on the back and cheering for "conservatism".

Whites have always emerged the greatest leaders and innovators in this world. A great society should consist of white leaders who hold the top executive, decision-making positions in business and finance. Financial compensation thus ought to be at the highest rate for Caucasians accordingly in this natural order.

Asians are the best workers out of all races, being obedient, studious and disciplined like no other ethnicity. The best fitting position for Asians and Indians is to support the white leader by doing the leg work, such as doing the math in the background of financial operations or scientific research. I have no doubt that Indians could make greater doc reviewers than faux-entitled middle class whites as long as their obedient attitude is intact. Unlike other minorities, Asians also respect whites and know their place in society, which is clearly below the white Anglo-Saxons.

Blacks and Hispanics are best fit for doing low-skilled labour tasks, such as in factory and fast food jobs. It's been proven that many blacks and Hispanics still didn't succeed naturally when a higher affirmative action job opportunity was handed to them. The thing about Better Coder is that, like him or hate him (and I'm sure most hate him), all indications are that the guy is real... he's not BSing us. There are some people who really do make a good living at this shit. It would make sense that eventually one of 'em would end up on here, create a blog, and start bragging on himself.

What's the big deal? The agencies do have their favorites, people who are very dependable, competent, always show up for a project, do everything right and don't argue.

Those people often go far in the coding world... as far as they can, which is not too far. They may be able to be make some serious bling doing this shit, but outside of this, there's no future, because coding experience counts for absolutely jack.

Still, BC is what he is, he's good at it, and for now at least (before someone named Rajiv eventually snatches his job), he's raking it in and living large!!

Nobody who does this crap for a living would waste precious money on a bottle Kame no O sake. For one thing, so many of us are buried under mountains of student loan debt, are struggling to afford outrageous individual health care premiums, and are fighting to keep our heads above water in some of the most high cost of living areas in the country. Anyone that actually has money wouldn't choose this work, but would rather gain experience in low paying shitlaw.

For another thing, aside from the naive lemmings that are blinded by a free slice of pizza or a taxi ride home at night (perks that only exist in a bustling economy), most people that do this kind of work are beyond burnt out. I'd rather be able to take a Sunday off than spend a couple of more hours at work sitting in a stuffy insane asylum so that I would be able to afford a fancy bottle of Sake.

Better Coder has no car payments, because he lives in the city. Like some of us fortunate people, he has no student debt. Don't know if he takes any trips anywhere... when I was coding my biggest discretionary expense was trips to Europe where I met my girlfriend.

Now the market seems to be heating up again (slowly) so doc review may be coming back. Just in time for me to quit my vomitlaw (one step above shitlaw) gig and get back into coding.

You shouldn't be there in the first place and if you are it should be short-term -- only enough to figure out a getaway plan.

You would obviously have to have a a very strange or drugged out personality to do that on a long-term basis.

Most normal people feel indignation, they speak out and get blacklisted and move on.

So true. People who do this are usually depressed. I know a few people who loved going to work on the weekends because they were severaly depressed losers who were depressed and they dreaded being at home alone. No one liked them or wanted to hang out with them - they had no joy in their lives.

Better Coder was originally a fry cook at Better Burger. One day they asked him to deliver an order to a law firm in midtown.

He saw all of the people lined up by the computers, clicking at the e-mails on the screen. They ordered by seamless web and received their meals for free, courtesy of the firm. Better Coder desperately wanted to leave the frying area and become one of the chosen, a doc reviwer.

So, much like the fake architect Wayne in "Something About Mary", Better Coder invented a glamorous, but fictional career for himself.

Sadly, Better Coder is no longer a fry cook at Better Burger, he got fired for stealing credit card numbers and cell phone numbers from actual document review attorneys. He took his fantasy too far and tried to steal the identity of actual DRAs.

So all of the meals at Nobu and other fancy joints are being charged to a real DRA's credit card. He's living a lie.

Watch out for Better Coder, he's a fraud!

Better Coder is more real than fake.

There is no big reason to believe the guy is a fraud. What is a fraud is when people come on here attacking someone who is successful at what he does, and has the temerity to talk about it.

My personal opinion of BC is that the story is essentially real, although he might be exaggerating certain details around the edges, just for effect.

People who come on here attacking the guy are doing so out of one motivation only: JEALOUSY.

They simply cannot deal with the fact that there are people out there who are more successful (or more lucky) than they are.

Actually with BC, it's probably something like 20% talent and skill, and 80% luck.

The guy has no law school debts and two trust funds, so he could relax and make decisions calmly after graduating from law school, instead of accepting the first shitlaw job offer he got would have landed him in a hellhole.

Obviously his grades weren't good enough to land him a BigLaw job, but he made the most of his situation. He liked the NYC lifestyle enough to not want to move out to suburbia or some second-rate, smaller and less competitive job market.

He stayed in NYC, accepted coding jobs, worked long hours and got in good with the agencies.

He got in at the right time, when coding jobs were still plentiful -- I mean before the bad economy hit.

Even when firms and agencies pared down and cut back, the coding jobs didn't disappear altogether. This guy stuck with it and persevered and got on the "A" list.

Why should people begrudge the guy if he knows the game, got in at the right time, puts in an honest day's work, and likes to live it up a bit in his downtime? That's just normal behavior.

I mean, the guy knows his limitations. He's not coming on here and saying he's an 18 karat gold associate with BigLaw or anything. He's a coder, he's not whining about it, and he's making the best of his situation.

I say "more power" and "props" to the guy.

Have you actually tried applying for jobs that don't require a JD? They'll hire you if they think you'll stay. So put something in your cover letter about how you want to change professions or whatever.

Also, it's not that hard to find a job as an attorney paying 50K or so at entry level. After 6 months you should be at 60K or so.

Quit wallowing and get over yourselves. It's not that hard to find a job, but it does take some effort and having to deal with a little rejection.

What I mean about your advice being "generally" good advice, is that the idea of saying you want to change careers will be credible for some, not so credible for others. There are a LOT of variables in this, such as:

1) Length of time you've been working as an attorney (too long might work against you)

2) Whether you'll be working among people who are likely to be put off or threatened by your law degree
