Fool Me Once

I received the following email from several ticked off people this week. If you have followed this blog for any particular length of time, you would know that a project offer from SkaTTTen is like receiving a vow of fidelity from Eliot Spitzer, or a promise from Barack Obama that taxes will not be increased on the middle class.

"Hello,

I wanted to update to let you know, with my deepest regrets and with Skadden’s deep regrets, that the project has now been postponed indefinitely. If anything changes, I will let you know as soon as possible. Clutch Group and Skadden both apologize for any inconvenience this may have caused you. I hope we have the opportunity to staff you on a project soon. Keep me updated as to your availability. Have a great weekend.

Temping is a nasty world. The recruiters don't give a shit.
My friend was recruited a few weeks ago for a three-month project by a large firm. First they interviewed him, and the fat partner swore it was three-months, then for three weeks they held him up on background check - during which the start date was undecided and he could not even start a small project. He gave up several projects in between just because he felt he had committed to the company and recruiter and felt bad about ditching them after an expensive background check. But they had no qualsm getting rid of people only within two weeks!!! Basically he put in a alot of time and money in this project and they did not give a shit.

Hilarious! I knew with absolute certainty the minute I saw the initial email that this gig would NEVER happen! Clutch is utterly notorious for this shit. Back when Joselle was there they pulled this stuff all the time. Clutch has never actualy had a project get started, it is aparently of bunch of lonely broads that post fake jobs to punk people. Clutch is a complete joke of an agency- once a year they post a $43/hr Skadden gig and get everyone all excited and then cancel it at the last minute.

It was either paying for a trip to the dentist, or falling back on my payments to Matasar's loan company. With that balloon interest rate, I chose the former.

Agencies do this all the time. They have a certain limited number of spots available, but they book 5x as many people as backups. If everyone show, they dump the rest. God forbid if the job candidates does this, They will be blacklisted. Double standard.

At this point, I would gladly trade in my NYLS degree and licenses to practice law for a full discharge of my massive student loan debt. They can even keep the portion I've already paid back during the time I've worked in doc review. We can forget this all happened and I can start over.

Can someone tell me how all these "law schools" that aren't part of a university started?

I mean, we have New York Law School, Brooklyn Law School, etc. And in California there are like 100 law schools starting with bigger ones like Southwestern "University", in LA, Cal Western and Thomas Jefferson in SD, Golden Gate in SF, etc. that aren't really part of universities or colleges.

How did all these bogus, phony diploma mills start?

I guess at one time it was really lucrative for a bunch of egomaniacal attorneys with delusions of professorship and deanhood to get together, raise a little cash, buy a building, recruit a bunch of loser dorks and nebbishes from Scarsdale and Weekhauken and East Orange and Staten Island, who couldn't get into real, prestigious universities, purchase a bunch of wood pulp wholesale on the commodities exchanges, and start running the printing presses nonstop 24/7, cranking out law diplomas as if they were toilet paper.

And maybe they are toilet paper by now. By now, word has gotten 'round that the LargeLaw firms are keelhauling their pampered Ivy-League (T14), Semi-Ivy League (Tier One), and Pseudo-Ivy League (Tier Two) associates, sending them on extended "sabbaticals" to teach Andean villagers in Peru and Tibetan monks English and how to wipe their asses, at 1/8th their former salaries, so the value of all these people's law degrees has plummeted like a naked, greased Rush Limbaugh sliding down Mount Fuckwad.

With that deflation, whaddaya all think the value of degrees from places like NYLS and BLS now are? Prolly worth about as much as seat on the Bangladeshi Turd Exchange.

Remember, this Recruiter job is viewed by them as just a stepping stone job. They want to move into the Vendor's Sales or HR Dept. This is the Recruiter's focus, not you! Recruiters can scr*w you over, then sleep well at night, at no cost to them.

The delicious Irony of this game is, that they will post for new job next week and you will send them your Resume after they scr*wed you over. Tell everyone you know Ms Recruiter X scr*wed you over. Ask for different Recruiter at her firm. Make her Job rough, then sleep well.

Can anyone please help me? I was unemployed for months and then one week in between I worked freelance for an attorney [who will issue me a 1099]. When I refile for unemployment after a break in the claim they ask me if I was self-employed?
Will I be denied benefits if I was self-employed?

I think the answer to your question is "yes", but you should check with your state employment agency, which would have the definitive answer. I don't think the answer to your question is a matter of the US Tax Code, I think it has more to do with the policies of the state unemployment agencies.

Am I correct in assuming that eligibility for unemployment has less to do with amount earned than how it is split over the quarters.

I earned more than $8910 in my high quarter but because half that amount [$4455] was not earned over the rest of the quarters I cannot get unemployment? I only made $2600over the rest of the quarters.

So essentially I would have been better off I had earned less in my high quarter. Let's say $5200 - that way the $2600 I did earn over the rest of the quarters would contitute half of high quarter and I could get benefits.

I am being penalized for earning more?? That does not make sense???

Yes, you can not be on unemployment any longer. It's a rough situation you're in, but my understanding is that people who are self-employed (or were self-employed) cannot claim unemployment. In general, there are two reasons:

1. Your employer pays unemployment taxes. Since you are "self-employed" (even though you worked for someone), that someone didn't pay unemployment taxes.

2. The self-employed exclusion is designed so that people who owned their own businesses, like stores at the mall, couldn't hop onto unemployment when mall traffic fell or whatever. It's unfortunate you are treated as self-employed even though in reality, you really weren't.



1:58, yes, you are correct in theory. I don't know the exact numbers for your jurisdiction. But those sound about right. Generally, the idea behind that is so the ue agency isn't paying you out at such a high compensation rate as if you were a high earner the entire year. This is why most people say as a rule of thumb that you should have worked at least 6 consecutive months before filing for unemployment. It's rare for people who have worked 6 straight months to be paid less than half for one 3-month period when compared to the other three month period.

it would have been better for you personally to have only earned $5200 in the one quarter. this is because it would've been better for the state, b/c the state unemployment agency only has to compensate you at the lower rate matching the 5200 high quarter, not having to match the 8910 high quarter.

I can see how that is unfair though.

I'm glad to know you're happy with your never ending project. It's such a great use of your JD to sit in front of a computer and read emails for a career. Are you working 60 or 70 hours a week?

The great thing about making a career out of coding is that you know what you'll be doing 5 and even 10 years from now. Sitting in front of a computer reviewing docs for 60-70 hours a week.

8:43 - If you are in NY, at your 1 year mark, they will review your work history and determine if you are eligible to start a new claim. If you aren't eligible, you can continue collecting under your original claim under the extended unemployment program.
