Today's Lesson - Outsourcing your future jobs to India

Saw an interesting video on Youtube. Apparently, this Paul Garrity character from Kelley Drye & Warren was boasting to a group of students at Cardozo Law School how he has been busy making money by outsourcing their future jobs to India. With Cardozo tuition now exceeding 40 grand a year, these kids should be crapping in their pants.

No question about it! Think how much more money and power the greedy partners will have when the outsource all of the menial tasks in the law firm to India.

Already, biglaw is an ivory tower. With the vast legions of staff attys, doc reviewers, paras and other support staff exported to India, no need to train or mentor all but the best and brightest. Sure, they will always need some staff, but far less than are currently onsite. In places like NYC where real estate is a huge cost, the Internet allows outsourcing to other places for pennies on the dollar. This is the swan song for big ticket NYC doc review.

Now American law grads, who went to law school expecting work in the USA to be protected by their guilds, finally graduate and pass the stinking bar only have their job or gig exported to save money to an "attorney" in an emerging market that is operating on 2 weeks of training in the American legal system. If ever there was proof that the American Law School curriculum, this is it.

How totally outrageous. The era of the bailout is ending and no one will have any sympathy for these lawyers that graduate without jobs. People will scoff and laugh and lawyers will largely represent a failure in life. In fact, for most, it already does.

No training or entry level jobs to speak of for '08 grads, excepting of course the much celebrated t14 or top ten %. Most biglaw associates don't get training or mentoring anyway, the bulk of them ending up leaving the law within 5 years.

Anyone going to a US law school is wasting their time. The profession is dying.

One of the lemmings in the audience should have asked the dirtball lecturer "so, you are pleased that the only jobs that many of us who will graduate from Carbozo will ever possibly get are going to be exported to India leaving many U.S. grads, including those from toilets like Carbozo unemployed or non-void walkin round like Pretty Boy Floyd?" Then said lawschool lemming should have said "it's like a jungle sometimes, it makes me wonder how I keep from going under!".

The answer is that the lemmings who sat before the subject lecturer have no clue how really important "e-discovery" will really be to THEM. How it will DIRECTLY IMPACT THEM. They have no clue of that it might provide them with their only option to extract any sort of worthwhile money out of a dying profession.

They don't realize that the lecture is about a subject that will effect them, not as partners or senior associates at some chi chi firm (because most will never ever attain such status having the scarlet T, as in toilet, firmly and deeply imprinted on their foreheads)directing the staff attorneys to properly supervise the nameless hordes of doc review attorneys be they American or Indian.

But, rather of how THEY will be among the nameless, subhuman doc reviewer hordes BEFORE folks like their esteemed lecturor ship those jobs overseas.

The lemmings have no clue that they won't be the massas and that they, indeed, will be treated as though they are the Tobys, i.e. very unprestigous plantation slaves of the legal world.

They believe that because they attended a highly vaunted Tier II toilet that happens to be aligned with the educational wing of the correct religion to be part of in NYC, that they too will become the ones with the power to act as a massa or a god over those who do not share their good fortune of perhaps being in or affiliated with the correct & priviledged educational, racial and religous group in today's lawland.

They have no idea that, by the virtue of their LSAT score, which begat their having to attend a useless tier II school which, for around 80-90% of its grads, will only begat a USELESS and unmarketable JD degree,they are, indeed, a useless,totally fungible bunch of fools who's only chance at a decent living is that subject that is being taught right before them and that said subject (in effect, doc review) is being shipped out from underneath them by the likes of the lecturor as he teaches.

We are just starting to complain, get used to it. When grads from professional schools have their jobs outsourced and their guild approves of it, something is seriously wrong. We have been lied to over and over again.

The riots and storming of the law schools are just around the corner. When these useless, antiquated, brow beating diploma mills graduate 80% of their students with zero job prospects (which also happen to be the ones with largest debt), there is a major problem.

We as lawyers should start by boycotting all things Indian. Start with Indian restaurants, no hiring of Indians here on work visas, and exposure of the shoddy conditions of these outsourced dumps. Ultimately law suits must be brought to force corporations to use American barred workers in their jurisdictions.

This is just the beginning of a long, hard battle, which will result in the closure of many diploma mills, defaulting of stidents loans and lawsuit after lawsuit directed at the defrauding law schools and student loan companies.

It's the beginning of something much bigger. As lawyers we have power, let's use it and stop being lemmings.

Boycotting Indian restaurants? That's right upt there with "freedom fries." Why should you boycott a type of restaurant, particularly given that many of them are owned by US citizens? It would seem racism is the only answer. Your proposal to not hire Indians is not only blatantly racist, it would be, for many companies, an unlawful policy, as it would violate federal, state and local laws against discrimination on the basis of national origin.

What, exactly, would be the basis of the lawsuits you speak of? Or is the idea to simply flood the courts with frivolous, groundless lawsuits?

I understand you are frustrated. But changing economies have always frustrated people. The key is to change with them, otherwise you will become just a bitter, unemployed luddite.

We all need to vote for Obama/Biden this November. While Obama isn't ideal, he's still better than McCain and that nutjob Palin, who will guarantee we all stay the way we have the last 8 years!

We need to stop outsourcing! And it's not racist to boycott Indian stuff. I'm a minority myself, and I am sick and tired of how people from India take our jobs overseas, plus take them here. Every where you go, there are Indian employees working here and then sending their money back to India! If they're going to work here, they should spend the money here! The same goes for the Hispanics who send their money back to Mexico or the Russians who send it to Russia.

Like the economy, the legal profession is ready to collapse. We need to stand together on this. Doc reviewers who complain about losing their jobs to India and whine about $10,000 medical deductibles and not being able to afford heat who give $250 to John McCain and vote Republican just to feel "important" like this one bottom feeder I know, deserve everything that has happened to them the past 8 years. I read this blog even though I am not a lawyer, or 'legal industry' worker, because it is the one place where the truth about this economy is clearly spoken . The truth is that technology, and the global economy have created a 'perfect storm' which will take your jobs away just as the blue collar jobs were taken away. I have seen it happen in my part of PA, and what scares me is now it is happening to you white collar workers in the capital of white collar work, NYC.

This will all end after the first malpractice case against whatever Vault firm fucks up a case by using Indian TTT's for the work American TTT's should be doing.

They arent just outsourcing doc review but legal research and writing too. The jump in malpractice cases is inevitable.

They outsources a lot of customer support and software work to India too that they later had to bring back to the US because of "quality" problems. Hindi speaking Indians simply dont speak and read english well enough to be doing doc review and legal research tasks. There is a reason why 55% of LLM's fail the bar.

I was the fellow who first suggested boycotting Indian restaurants. Initially, my opposition was a reaction to outsourcing. However, their kitchens are filthy. Individually they frequently reek of BO. Some Indians can empty an elevator due to odor.

My comments are not intended to discredit these worthy immigrants. They have different notions on sanitation.


Some prior blogger asked why we are no longer discussing Anita. Her poor and sad behavior is an issue of the past. Now outsourcing has replaced this c*nt's conduct. It is of current relevance. Actually, I'd rather do battle with a twat like that, than be subjected to global resourcing.

The threat of Indian outsourcing managed to beat out the petty tyrants who formerly were opposition to a fair and decent standard of conduct.

I could have never predicted this and no one else could have either.

These people are not licensed to any U.S. bar. Despite their "supervision" by some crappy associate or staff attorney, I fail to see how they compare. If mass tort ligitation is to be handled properly, then U.S. attorneys should be employed to handle electronic discovery.

Common sense and decency and licensure should allow some small level of protection for the value of ABA approved schools and state bar passage.

What a disgrace. More loopholes...more theft. The quality of their work cannot be the same. At some point, a clear malpractice error will be made and some mass tort defendant is going to be fucked... And they will deserve it... Our lousy U.S. coders still are more competent than the Indian counterparts.

Many company feedback studies have shown that Indian workers produce higher quality work than their American counterparts. Better quality at a lower price. Why on earth should a firm pay you in this situation? Their not running a charity. If you find the industry unattractive, then you should exit it and do something that makes more economic sense.

the bitterness here is palpable.
it's also misplaced. my guess is that many of the people here were sold on the idea that if they took out a lot of loans that they would easily pay them off with a law degree. and, of course, that turned out to not be true.
the people you should be angry at are the loan originators (i.e., the banks and financial services and to a lesser extent the law schools). the point is that they make their living by having you take out loans. now it's too late, so you will just have to find something else to do. the sooner you do that the better off you'll be.

The quality of Indian outsourced work is so poor that many (nonlaw) firms are unoutsourcing.

Many of my college friends work in high tech in silicon valley... they constantly complain about having to completely rewrite all the code they get from India on their projects. Constantly having to push back deadlines by many months at a time. Firms are discovering the cost savings isn't worth it.

Also, the cost savings is disappearing. I read an article a month ago that when outsourcing started 8 years ago there was a 7:1 wage advantage in India. It said that was down to 3.5:1 today.

There seems to be mixed reports on the quality of work done in India. Some say it is superior, others say it is worse. The market will decide the answer. If it is better, and cheaper, then it is appropriate and desirable for the work to go to India. If it is not, then it will stay in the US.

Comparative advantage and free markets is the American way.

A lot of you guys are right, there is no need to panic about doc review going to India. I know a lot of Wall Street guys and IT guys: they all say the same thing, the work product in India IS ABYSSMAL. Big companies are tired of these idiots fucking up and getting a shitty work product, that they're now pulling out of India, and other places. A friend of mine who works in IT said they (A Fortune 100 company) just shut down an entire operation in Eastern Europe because they REALLY fucked up.

Yeah, but the market is skewed. How can we compete with the Indians? The ABA requires us to attend one of their expensive ABA law schools, while the states mandate bar passage and the payment of expensive CLE fees. The ABA meanwhile allows the Indians to sit for a cheap two week crash course. I am tired of Americans being discriminated against.

5:17- No, I AM being discriminated against because I am an American. If I want to do document review work in America, I have to show the staffing agency that I am licensed. To get that expensive credential, I had to invest boatloads of time and money. If the ABA wants us to compete with the Indians, I say fine, but how about we close down some of these overpriced American ABA TTT law schools that engage in outright and blatant accounting fraud, fraud to which the ABA turns a blind eye to.

Let's keep the lawyers and export all of their work. Let's also keep opening up law schools to insure that the educators get rich while grads salaries plummet towards the poverty line.

Of course it makes no sense and will lead to the collapse off yet another speculative bubble in which participants were lead astray by entrencned, highly profitable interests.

It's time reclaim common sense in this country. The first step is to sue the student loan companies for usury and fraud.

Then we get the law schools, law firms and the ABA.

Thanks for having the guts to publish this site. I didn't know this was still going on -- and that the epidemic has grown substantially. I have similar background; attended T-4 law school, got little help with job after graduation, had crushing debts that altered my life. I did however get a job. I've since left the churn, and haven't thought about it for a while, until this issue came up. Now I'm reliving my early 20's all over again. My sympathies to everyone still in the churn (and were sold a bill of goods).

In what way is there "massive exaggeration" of law school stats or other "unattractive accounting"? Examples, please? The professor also seems to be pulling his punches; he says that the matter would be "borderline scandalous," which is to say that it may not be a scandal at all.

5:26 - Like we are supposed to believe that the average kid coming out of place like Tulane is pulling down 125K a year. That is what a school like Tulane claims while they keep cranking up tuition year after year.

You are right, with the schools holding all the cards, it is very hard to pin them down. The truth of the matter is that unless we are able to pin down and depose someone like Joan King under oath, we won't be able to figure out how exaggerated some of these figures actually are. It's not like however we didn't try. Several people have sued the school in recent years, but the judge who benefits from free interns and potential part-time adjunct teaching positions, wouldn't let the case advance to the discovery stage. Also, as a result of much online activism, reporters from the WSJ contacted Joan King to discuss the issue of post-graduate career reporting. As is apparent to anyone who had read the article, Ms. King was evasive, spoke in broad generalities, and when asked, wouldn't provide for any concrete figures.

5:26 - It seems you may have grounds for suspicion, but no evidence of an actual lie. If you can't point to a demonstrably false statement that was made, then accusing someone of lying is inappropriate. Of course statistics have long been compared to lies (there is that famous saying about the three kinds of lies being lies, damned lies and statistics), and reasonably intelligent law school applicants should realize the potentially misleading nature of statistics. To say that the average salary was 125,000 may mean that one person made nothing and another made 250,000.

The NALP numbers are fairly accurate. 1 year out 8% of graduates are unemployed, close to 25% of graduates dont actually practice law, but work in other fields. The median salary for those employed is 62k and this includes the 10%+ who work in biglaw. Take out the biglaw externality and the median is in the low 50's. The median debt load I believe is about 80k now, it was 67k a few years ago.

Law school is a financial disaster for the vast majority of grads.

Lets even pretend that most grads will eventually make 100k as practicing attorneys. With 10 years of experience you can make 100k in just about any field and you dont have to take on the debt or the opportunity cost of law school to get there. 3 years of lost income while you are in school is an invisible 100+k in additional cost the brochures never mention.

Not everyone went to law school primarily to make money, but rather because they found it intellectually interesting, provided an opportunity for personal growth, and/or they felt it could contribute to the greater good of justice.

This is not to say that those with more mercenary motives acted erroneously, but rather to stress the fact that earthly lucre is not the end all and be all (or even the primary good) of education.

3:27: While I'm sure there is much to criticize at Lehman Bros and their ilk, I hardly think "all employees" there are to blame. Somehow I expect the receptionist and secretaries had very little to do with it.

I think that things will change very very quickly over the next 5 months in the entire profession due to the fall out from the demise of the major institutions feeding the trough of so many BigLaw Firms....look closely and you will eventually see the demise of many law firms currently feeding work to India.....no one knows where this baby is going to end up for any of us....most of this blog may be moot within the next 9 months......

3:02 - Racism is a feature of many cultures; I really don't think Indians are particularly racist as a group compared to others. It is true that many high caste Hindus may display some disdain for others, but this is not, at least not primarily, a race-based matter, but one of class and social position.

8:47, Alexass possesses no personality or soul, so it is doubtful he will attract a soulmate. This grasping fool is the classic example of what results when an insecure failure is mistakenly granted a petty amount of limited authority.

Sadly the firm is unaware of his inappropriate professional and rumored sexual misconduct. Besides, they maintain professional liability insurance for such instances. They probably wouldn't care anyway. One at his lowly level is considered comparable to the unfortunate mentally challenged man who cleans cages at the zoo. However, the zoo janitor is probably more decent, ethical and productive.
