Kelley Drye & Warren - Corporate Criminal


Justine Clark, a partner at Kelley Drye & Warren, just plead guilty to state income tax evasion. Despite the fact that KDW has seen a steady growth in profits per partner, and despite the fact that KDW has benefited from a steady stream of contract attorney outsourcing, Clark, with greed unquenched, went ahead and screwed New York State out of close to $200,000, based on her $ 2.7 million earnings.
Her penalty? A slap on the wrist misdemeanor.

David Lat (Abovethelaw.com) thought I was a little too harsh on Ms. Clark:
Okay, that's a little harsh. As the New York Post notes, Clark earned $2.68 million not in a single year, but over the course of five years (2000 - 2004). That averages out to a little over $500,000 a year.

And in New York City, teeming with i-bankers and hedge funders, you're a pauper if if you're not taking home seven figures per annum. So can we really blame Justine Clark, struggling to keep up with the Joneses, for trying to keep a little more for herself?

Four attorneys were among seven professionals who have pleaded guilty to failing to file state income tax returns in the latest round of prosecutions resulting from the matching of state tax records against lists of professionals licensed by the state, the Attorney General's Office announced over the weekend.

The four lawyers failed to file income tax returns for four consecutive years, and pleaded guilty to misdemeanors.

The earnings of the four ranged from between $2.7 million and $394,000 during the years at issue, the office said.

The four include Justine Clark, a partner at Kelley Drye & Warren, who earned $2.7 million over the four years, the most of the four lawyers. She said yesterday she had no comment.

The others were John Lynch of Manhattan, Ronald Goldman, of Brooklyn, and Lawrence Wechsler of Great Neck.

In addition, two doctors and a nurse pleaded guilty to not filing returns.

Since the matching of tax records against professional licenses began about two years ago, more than 11,000 professionals have been identified as not having filed state income tax returns. To date, audits have been conducted of 2,200 of those identified and assessments against them exceeding $12.8 million have been issued, said Michael Bucci, a spokesman for the Department of Taxation and Finance.

That would be the amount of her compensation attributable to NY, with the rest spread out over the firm's other offices.

She pulls down much more than $500K a year.

nothing new... During his NYC mayoral campaign, David Dinkins admitted to failing to file his federal income taxes for the prior 4 years, and STILL got elected. Mr. Dinkins was also licensed to practice law. (This was going on about the same time that Marion Barry was reelected DC Mayor despite his own legal troubles.)

This is fucked up. Last year, some guy from the unemployment office called me up and started to yell at me. He claimed that I overdrew $300, and that I was going to be possibly prosecuted. When I got off the phone, I started to cry. After I submitted proof and cleared my name, I breathed a sigh of relief.

I hope Justine shit stains the reputation of this entire firm. When I was there, they turned off our internet access, placed an around the clock babysitter in our room, and fired us all after they outsourced our whole team to India.

i've met justine and this is totally inconsistent with my experience of her, so something seems off about these news reports.
