The "Lex-Pollution" Tax Audit



"TTT, here is the language of the warning I received:

By now you would or should have received in the mail a standard letter from Lexolution on Lex letterhead which reads: we are being audited by the NYS Taxation and Finance Department to determine compliance with the state's regulations regarding income tax withholding.

As part of the audit, we were asked to contact a number of current and former employees and request they complete form AU-7, the "Employee Wage Statement" (enclosed.)

This form lays out wages paid by Lexolution to you in 2005, 2006 and 2007 on which either

1) no state tax was withheld, corresponding to pay periods when you requested that you be classified as "exempt" in our payroll system, or

2) due to changes in withholding status you asked us to implement during the withholding period, it appears that an incorrect amount of tax was withheld.

On the form, you are asked to certify that these wages were reported on your NYS tax returns in the appropriate years, and that you have paid the taxes due on these wages.

Please return the AU-7 form in the enclosed post paid envelop, by 12/12/08. If you do not return the AU-7, we will note that in our response to the auditor.

I hope they audit and fine Dickhead Osman for his persistent abuse and violations.

What about an OSHA and/or NYC Fire Department inspection of Lex sites? That would be awesome to have them up to code.

Notice how they say, "If you do not return the form to us, we will note that to the auditor." They act as if this tax issue is our fault, rather than thiers. Even in this, they take no responsiblity.

Wow, I wonder what the float on that cash is. Stealing from temps' tax withholdings is about par for the course for these utter sleazebags.

Some of the genius attorneys that were too smart to have to pay taxes are getting nailed. Every project I've been on someone tries to pull this nonsense. Talk about stupid. At least when someone is overbilling the client, it's difficult to prove (and nobody relly cares that much anyway). Screwing around taxes on the other hand, is a flagerant and documented violation that will get you into trouble. Talk about stupid.

The Feds are more interested in the temps than Lexsolution.

Do you relly think that Lexsolution is going to try and cheat on withholding taxes from employees? They're a multi-million dollar buisness with a team of accountants that are disconected from the sales staff. The accountants are hardly going to colude with the sales staff so that the sales people can make an extra 1000 bucks.

Don't kid yourself, it's the temps that thought they could get away w/o paying taxes --a relly stupid move-- that they're after.

Yes. I once met a temp recruiter who tried to talk me into the benefits of being an independent contractor. Anything for these snakes to save a few bucks. Shady, shady, shady.

The "smart" temps who thought they were beating the system by doing this will be nailed with penalties and interest on top of back-taxes....this is a very very deep black hole. There is a maneuver around it, but unfortunately, it won't work....I hope they find a good tax accountant or tax attorney and start talking "offer in compromise".......this could move many of these temps to being forced to file in bankruptcy, but the problem is that like student loans, this baby won't be dischargeable........sorry suckers.
