The Return Of "Frankendine"



The ghastly E.P. Dine temp agency (a.k.a. "Frankendine") is at it again. I knew it was only a matter of time before "Frankendine" would awaken and once again terrorize and try to rip off young attorneys:

"A few of us were employed at EP DINE for a job with the NYC Legal Dept. We were told it would be 40 hours per week with no weekends.

The supervisor at NYC Legal insisted that we work on weekends - she was aware that all of us had put in 40 hours. Usually this isn't a problem - you do whatever the boss says and get paid. All of us worked really hard. We were all hired by Shawn Treadwell. We all thought he was a nice guy, but he wound up firing those of us that demanded our pay.

EP DINE refused to pay anything over the 40 hours - between all of us that was over 100 hours.

I am astounded that we were dropped for asking for our pay.

NYC Legal conditions were also awful; there were giant roaches walking near the kitchen - signs posted by people about it - just gross."

File a claim with the Wage/Hour Division of the NYS Dept. of Labor. It costs nothing. They investigate, and you will get your money.

FWIW, the regular emplyees (lawyers, paras, secretaries, etc...)at NYC Legal also endure the conditions the contract attorneys do. It doesn't excuse a gross workspace (and I bet Bloomie doesn't have to work in squalor) but hey - at least NYC Legal is not being intentionally abusive as to environment like the private sector likes to be these days.

I heard that there is some deal Dine has with the NYC Law that caps it to 80 hours for 2 weeks adn that Dine will never pay a rate more than $40/hr... BUT I have heard there are long term contract attorneys there getting more! It is all such a sick game.

Can someone claify something:

Did you guys not get paid b/c your hours were on a weekend? OR are we talking about you being asked to do overtime and that you are not being compensated for that? Overtime, of course, brings up that whole other issue we all worry about... are we exempt as lawyers or are we not exempt b/c it might be monkey-work and if it's monley-work do they actually have to use lawyers adn can it be sent to India (see below) adn all that stuff.

You are hourly employees, it's not a matter of being paid overtime, it's a matter of getting any pay at all for weekend work.

Don't muddle the issue, If this actually happened as they say, EP Dine needs to pay these temps for the hours worked, unless they signed a contract to the contrary. They're not on salary.

Hasn't anyone actually read the law?

Hourly wage workers are not exempt (unless they are employed by government), regardless of whether they're professionals or not.

If you are an hourly temp, employed by a private agency, you are not exempt!

1)EP Dine just started blitzing DC w/offers for $32 per hour, while in 2 years of doc review I've never gotten less than $35, so I see why my NYC brethren have been incensed.

However,

2 people ignore their employer who told them to work 40 hours per week, no weekends, and a third party on site at NYC Legal tells these cretins to fucking work on the weekends regardless of pre-arranged agreements: And these greedy cretins work despite their Employer telling them NOT to work. Fuck them. There are thousands of us, and some jerkoffs among our ranks really are here because they are stupid, not because of the system or that they are brothers or need the money for loans. I like the first week of a project because the crazies usually get dropped and we can stop listening to them whine.

Tom, celebrate the fact thousands of us have this stupid, high-paying temp work to do, and please don't waste our time celebrating those who don't recognize a clear chain of command. These were not Quakers who had no understanding of the military, with a highly regimented, strict, hierarchical structure. This entry on EPD is about two losers who disobeyed their employers because they were greedy. Castigate them, not an employer who demands "no weekends". Fuck NYC Legal, they are not the employer.

Please do more of your own blog's posts. You are delegating to someone not nearly as critical a thinker as you who created it, years ago. Get off your ass and edit. We want your thoughts. This clearly is not an entry from "Tom".

After working for E.P. Dine for almost 4 years on a headliner litigation, being one of the highest billing project attorneys, I had the identical experience. There is a pattern. However, it goes back almost 10 years when the head of Dine worked for another agency. This is merely a way of "doing business"...you don't pay the temp, wait to see if they sue, and then settle on a far lower amount much later (saving money in the interim)e.g. far lower than what was legally due and owing. Many NY attorneys and professionals do business this way. The trick is to spot them, and be sure to never work for them. Everyone in the industry knows this about Dine, including law firms who've hired them to find contract attorneys. Sooner or later it will hit them where it hurts, the bottom line - particularly in this slowing economy and consolidating/changing field of law. What they don't calculate into their equation is that each of us who has worked for Dine and who experienced the foregoing business practices, have very very close friends, husbands, partners, lovers et al and former colleagues who work for the identical law firms they hussle. We just need to make sure that Dine is taken off their "A" lists.....not too hard to do is it. It is NYC! In NYC, there is always a way.

He doesn't care that your wife and children aren't being fed just so as long as he is making the money to keep up his sex addiction. This review has been over for months - furthermore all of us who know anything about this industry should know the pay and supervision doesnt come from the agency, much less Mr. Treadwell... and the personal attacks? 8:54, it's Treadwell's (and FrankenDine's) bald-faced lying over and over again to temps about pay rates and hours that get their names sullied about on this blog. Where there's smoke, there's a fire.

Believe it or not, there are a few agencies and recruiters in NYC who treat temps with a modicum of respect, don't lie to them, and recognize them as fellow human beings instead of solely as commodities. That's why you don't hear about them here.

Not that the "good eggs" aren't taking advantage of us, too. But at least the pay rates turn out to be what they advertise them as. None of this "pay rate will be between $35 and $40/hr." What are you going to do, Shawn? Pick it out of a hat?

And at least they don't pull "bait and switches" with the # of hours and OT - remember the Quinn project? Advertising it as 60 hrs/wk and paying OT, but then having it turn out to be 40 hrs/wk until Quinn "approved" the OT?

[It's pretty obvious FrankenDine did this because they weren't confident they could staff the project if they told the truth about the hours and OT policy. After all, they're not used to staffing projects that have OT, right?]

These are the types of things that get an agency and recruiter written up on here.

I feel the nastiness and personal attacks are a product of the frustration people feel about these "bad egg" agencies and recruiters. The gloves come off when people are fed up and don't see any other options.

Please go to Portfolio.com's "Corporate America's Revolt Against its Lawyers........we are far behind the curve. It is a matter of time before Dine will be out of business. Give it another 12-14 months. On the heirarchy of temp agencies employing contract attorneys, given the trend outlined in the Portfolio.com piece, there we only remain 1-2 agencies, but I do not think Dine will be one of the survivors. Shawn will be looking for another job quite soon. Trust me.

With regards to temp agencies "life", at least in NYC.....Since the late 1980's when Leslie Friedman, Esq. (former Skadden Arps et al) began Special Counsel, the contract attorney game has morphed 3-4 times. Expect, the same...it will be forced into another morph...Treadwell will be out of a job, no matter how it morphs. He's reached his zenith in the intdustry, but with a bad bad rap.

I know this thread is old, but I just recently had communication with Shawn Treadwell who is now working for B3 Legal. I was recruited for a San Francisco review project slated to start on 1/2/2013. I just got a call today that it was cancelled last minute. Why would anyone cancel a document review? I'm still going to show up on the 2nd to see for myself whether this thing was actually cancelled or not. Seems odd.

Just finished earning 3 credit hours of CLE and feeling good about it. And since these credits were in ethics and professional responsibility, it got me to thinking about...well, ethics and professional responsibility. While I have so much to write, I cannot just yet due to present and soon to come litigation.
For now, I will say only that I have documented proof positive of several crimes having been committed against me by a middle aged woman with red hair and freckles and an admittedly beautiful smile who has been vilified frequently in this blog; in my OPINION, for good reason. Much of what has been written about her I can attest to as being FACTUAL. For my part, I can state unequivocally that this woman has criminally trespassed, threatened me with death, has called me a child molester (because prior to this woman I was seeing a 30-year old woman and a 32-year old woman) (and keep in mind this frequent target of vilification who called me a child molester has herself repeatedly slept with a 30-year old in Miami, Florida who also provided her with...I will save telling you what this 30-year old provided her with for a future post...suspense will keep you coming back, I hope!

But, hypocrisy is not against the law, so she gets a pass on that one. What is against the law is conversion and a host of other crimes which I will not divulge now but will be so alleging was committed against me in due time.
Further, a certain detective within the 34th precinct and one in the 19th precinct, as well as the State and City of New York, have all thus far essentially been complicit in the crimes against me since despite having been provided proof positive of some of these crimes, this woman has yet to be held accountable, I have faith in the law for, unlike the topic of this blog post, I did earn a JD and did pass my bar exam. (Ecstasy is apparently one helluva drug, but it apparently has consequences. Guess that is why they call it "dope".
I also have faith because a quick Google search confirmed a sneaking suspicion I harbored; to wit, that the U.S. Constitution has not been abolished nor has its ratification been challenged; successfully, anyway.
So I have faith that the fact that thus far my 5th, 14th, and other Amendments and civil rights have been violated, and two detectives of the NYPD are guilty of, at best, dereliction of duties (and I am being kind there), it has all been a Shakespearean-like tragedy of errors which will be made right. If it is not made right, fortunately I have several legal avenues open to me, including filing a Notice of Claim against the...let's save the rest for a later post.

But the worst part about all of this, for me, was seeing my Mom cry at a recent court appearance and her having to lend me money for a legal defense.
And while this woman knows she is guilty, she also knows that she was given several opportunities to make amends even AFTER these crimes were committed...just the kind of forgiving guy I am. Even after having been arrested I was thinking of letting it all go. What this woman does not know is that seeing my Mom cry and to have had to watch her loan me some of her hard earned money...well, dat was the Rubicon, yo! That was the point of no return. The event horizon.
This evil and bitter woman, for now let's call her HPV, rather than drifting off into distant memory as one of a few ex-girlfriends has seemingly developed some sort of obsessive hatred of me and refuses to leave me the fuck alone and return my belongings...yes, she threatened me dead. Yes she still has keys to my apartment and building. Yes she scares the living shit out of me. But I am no coward. And in the words of Winny Churchill, “Never give in–never, never, never, never, in nothing great or small, large or petty, never give in except to convictions of honour and good sense. Never yield to force; never yield to the apparently overwhelming might of the enemy.”

In the meantime, I take solace and refuge within the First Amendment (which yet another diligent Google search confirmed still applies to the constitution my first Google search confirmed still applies)
One last note for today...if any of the kind jailors of the tombs at Centre Street are reading this, please be advised that I am seriously considering making a strongly worded motion to have those peanut butter and jelly sandwhiches you serve to your guests declared unconstitutional as cruel and unusual punishment. In what dimension does that shit even resemble peanut butter? I mean, is that shit man made or from outer space? Dayuuuum!
To be fair though, I do have to say I appreciated having the choice between low- and full-fat milk versions.
I went with the full!
